1. Overview

These terms govern your use of the kPixies website (kpixies.com) and your application for kPixies performance marketing services. kPixies is operated by Peter Benes / Benes the Menace ("we," "us," "our"), based in Prince Edward County, Ontario, Canada.

By using this website or submitting an application, you agree to these terms. If you do not agree, please do not use the site or apply.

2. Services Description

kPixies provides performance-based Google Ads campaign management for qualified retail businesses. Our service includes campaign setup, optimization, monitoring, and monthly reporting. Specific service terms, including the fee structure and performance guarantees, are communicated during the onboarding process and formalized in a separate client agreement.

3. The 5X ROAS Commitment

Our website describes a performance-based fee model where management fees are $0 if campaigns do not achieve 5X return on ad spend (ROAS) in a given month. This commitment is subject to the following:

• ROAS is measured using Google Analytics (GA4) data with direct click-based attribution.
• The commitment applies to kPixies management fees only. Clients are responsible for their Google Ads spend regardless of ROAS performance.
• Specific terms of the performance guarantee are detailed in individual client agreements, which govern in the event of any conflict with this website.
• Past results shown on this website are from specific client engagements and are not a guarantee of future performance. Individual results depend on factors including product category, market competition, website quality, pricing, and ad budget.

4. Application Process

Submitting an application does not guarantee acceptance into the kPixies program. We pre-qualify applicants to ensure mutual fit. We reserve the right to decline any application at our discretion.

5. Ad Account Ownership

Google Ads accounts created and managed by kPixies remain the intellectual property of kPixies. Clients retain full ownership and control of their Google Analytics (GA4), Google Merchant Center, Google Search Console, Shopify, and all other business accounts and data.

6. No Contract Lock-In

kPixies engagements operate on a month-to-month basis. Either party may end the engagement at any time, subject to the terms of the individual client agreement. Outstanding fees for the current billing period remain payable.

7. Website Content

The content on this website is provided for informational purposes. While we strive for accuracy, we do not warrant that all information is complete, current, or error-free. Case studies and performance data represent specific client results under specific circumstances.

8. Limitation of Liability

To the maximum extent permitted by law, kPixies / Benes the Menace shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of this website or our services. Our total liability is limited to the fees actually paid by you in the relevant billing period.

9. Governing Law

These terms are governed by the laws of the Province of Ontario, Canada. Any disputes will be resolved through good-faith negotiation, followed by mediation if necessary, in Prince Edward County, Ontario.

10. Changes to These Terms

We may update these terms from time to time. Changes will be posted on this page with an updated revision date. Continued use of the website after changes constitutes acceptance of the revised terms.
